Code of Conduct
It is the intent of this Code of Conduct to provide principles and standards for the professional and ethical conduct of PERA's members and users and to promote and nurture respect for the integrity, expertise and reliability of all PERA members.
The members of the Production Equipment Rental Association have declared to honor and abide by the Code as adopted by the Association and to ensure the public of uniform high standards in all dealings with members of PERA.
The Ethics Committee of the Association is charged with the enforcement of the Code and meets regularly to consider alleged violations. It is the responsibility of all members to respond to any complaint of violation communicated by the Association and participate in all processes and procedures employed by the Committee during the investigation and possible enforcement of the Code with respect to the complaint. Any and all members found in violation are subject to various sanctions up to and including expulsion from the Association.
The following Articles of the Code indicate the dedication of the members of the Association to maintain the highest levels of ethics and responsibility in their relationships with other members, clients and the production industry at large.
ARTICLES OF THE CODE
- Article 1 -
To abide by all applicable laws, codes and regulations and protect the public against fraud and unfair trade practices.
- Article 2 -
To employ the extensive use of unified ethical business practices and professional relationships among members, clients and associates in the production industry.
- Article 3 -
To endeavor to provide their clients with the highest level of professionalism, service, safety and performance for all services and equipment.
- Article 4 -
To provide a safe working environment for employees and clients.
- Article 5 -
To present equipment and services truthfully without misrepresentation.
- Article 6 -
To be responsive to and available for all clients before, during and after the rental, sale and/or service.
- Article 7 -
To refrain from discriminatory and/or abusive practices in dealing with employees, customers, fellow members and industry associates.
- Article 8 -
To impart expertise, skills and knowledge to enhance development within the industry while demonstrating absolute consideration and respect for the confidentiality of customers, members and industry associates.
- Article 9 -
To acknowledge the rights of others to vie for commerce.
- Article 10 -
To fully divulge common or related ownership of entities involved in any competitive bid process.
- Article 11 -
To completely disclose the terms and conditions of all agreements or undertakings to all relevant parties.
- Article 12 -
To follow through and complete any lawful agreement, including but not limited to the delivery of all goods and services contracted with all clients; payment of all debt incurred with vendors, suppliers, contractors and others with whom you have entered into a binding agreement, including other PERA members; and to, in good faith, develop binding work-out agreements with vendors, suppliers, contractors and others with whom you have entered into any binding agreement when faced with the inability to pay debts timely and according to the original written agreement terms.

To support and honor the Association by taking a proactive role in PERA activities and promoting the Association to the production industry through advocacy on issues of concern, facilitating the exchange of information and support for programs that encourage safe and successful use of equipment
The Association's Ethics Committee reviews infractions of the Code. It is the responsibility of all members to respond to any complaint of violation communicated by the Association and participate in all processes and procedures employed by the Committee during the investigation and possible enforcement of the Code with respect to the complaint. A member who violates the Code may be faced with disciplinary action and/or expulsion from the Association.
